The Board of Zoning Appeals (BZA) is a quasi-judicial body that would provide property owners the opportunity to challenge decisions made by the Village of Warrens regarding zoning laws and ordinances. The Board ensures that zoning decisions are fair, consistent, and in accordance with state law and village ordinances.

The primary function of the Board of Zoning Appeals is to hear and determine requests for variances, special exceptions, and other appeals related to zoning decisions. Property owners, developers, or residents who disagree with a zoning decision made by the village or zoning administrator may present their case to the Board. The BZA serves as a final decision-maker regarding changes to zoning ordinances and variances.

The Board of Zoning Appeals operates under Wisconsin State Statutes Chapter 61.35 and 62.23. These statutes provide the legal authority for zoning ordinances, including the creation of zoning boards and the power to grant variances, special exceptions, and hear zoning appeals.

Filing an Appeal
Property owners or applicants must submit a formal written appeal to the Village Clerk if they disagree with a zoning decision or wish to request a variance or special exception. A complete application and necessary documentation must be provided, including any relevant evidence supporting the appeal.

Public Hearing
After the appeal is filed, a public hearing is scheduled where the appellant (the person filing the appeal) presents their case to the Board. At the hearing, the BZA will review the facts, listen to public testimony, and consider any evidence provided.

Testimony & Evidence
During the hearing, both the appellant and the Plan Commission present their cases. The appellant may present evidence such as maps, photos, property comparisons, or other relevant information. The Plan Commission will provide evidence supporting the original decision.

Board Decision
After reviewing all evidence, the Board of Zoning Appeals will make a decision to approve, deny, or modify the zoning decision. The BZA must base its decision on the criteria established by the zoning code and state law. The decision of the BZA is final, and the appellant must accept the outcome unless new evidence becomes available or there are other exceptional circumstances.

The Board of Zoning Appeals would typically meet as needed, based on requests for appeals. The meetings will be scheduled as required, and the public will be notified in advance of the date, time, and location of the hearing.

The Board of Zoning Appeals consists of three to five members, appointed by the Village Board for staggered three-year terms. This ensures continuity in the board’s operations and provides an opportunity for new members to join the board.

  • Chair: The Chair is responsible for overseeing meetings, guiding discussions, and ensuring that proceedings are conducted fairly. The Chair leads the decision-making process and ensures that decisions are in compliance with state statutes and local zoning laws.
  • Vice Chair: The Vice Chair assumes the role of the Chair when the Chair is unavailable. The Vice Chair assists in organizing meetings and ensuring the smooth flow of the hearing process.

Each Board Member is responsible for:

  • Reviewing and considering zoning appeals and making decisions based on the facts presented.
  • Participating in public hearings, ensuring that all legal requirements are met regarding notices and public participation.
  • Adhering to state statutes and local zoning ordinances.
  • Making unbiased decisions and ensuring the fairness and integrity of the zoning process.
  • Working collaboratively with other board members to uphold the integrity of the zoning laws.

Board members will serve three-year terms, with terms staggered to ensure a mix of experienced and new members at all times.

The members of the Board of Zoning Appeals will be appointed by the Village Board as the board is established. The initial terms for the board members will be staggered as follows: 2 members will serve 3-year terms, 2 members will serve 2-year terms, and 1 member will serve a 1-year term.
